Scope and acceptance

This Privacy Policy and Terms of Service agreement (“Agreement”) describes the practices of Smarter Solutions LLC (“Smarter Solutions,” “we,” “us,” or “our”).

By visiting our website, requesting a quote, booking a service, creating an account, connecting an integration, accessing Smarter Growth OS, or otherwise using our services, you acknowledge that you have read and understood this Agreement.

If you use our services on behalf of a business or organization, you represent that you have authority to accept this Agreement and connect any related accounts on its behalf.

Information we collect

Information provided directly by users

• Name, business name, title, and contact information.
• Email address, telephone number, and mailing address.
• Service address and property-access instructions.
• Quote requests, appointment details, service preferences, photographs, and messages.
• Account registration and profile information.
• Marketing objectives, service areas, target audiences, campaign preferences, and budgets.
• Support requests, feedback, dispute information, and communications with us.

Information collected automatically

• IP address and approximate location.
• Browser type, device information, operating system, and language.
• Pages viewed, buttons selected, referring pages, session activity, and timestamps.
• Cookies, local storage, analytics identifiers, and similar technologies.
• Security events, login attempts, error logs, and audit records.

Information from connected services

When an authorized user voluntarily connects a third-party service, we may receive information made available through that service’s API and the permissions selected by the user.

How we use information

We may also use aggregated or de-identified information for analytics, product improvement, forecasting, and operational planning, provided the information does not reasonably identify an individual or customer account.

Smarter Growth OS and Google API data

Smarter Growth OS is an AI-assisted marketing automation platform developed and operated by Smarter Solutions LLC. Authorized users may connect their Google accounts through Google OAuth to use approved Google Ads, account-management, reporting, analysis, and optimization functionality.

Google information we may access

Depending on the permissions granted and services connected, we may access:

• Google account identifiers and authorized account information.
• Google Ads customer and manager account identifiers.
• Campaigns, campaign settings, advertisements, assets, and ad groups.
• Keywords, search terms, targeting criteria, negative keywords, and audiences where authorized.
• Budgets, bidding strategies, bid information, and budget pacing.
• Conversions, conversion actions, attribution information, and performance metrics.
• Clicks, impressions, costs, CTR, CPC, CPA, ROAS, quality indicators, and reporting data.
• Recommendations, campaign health information, and related account-management records.

How Google information is used

• Display connected account and campaign information.
• Create, edit, or organize campaign drafts.
• Prepare advertisements, keywords, targeting, assets, and budget recommendations.
• Generate dashboards, reports, alerts, summaries, and forecasts.
• Monitor performance and identify anomalies or optimization opportunities.
• Apply user-approved changes.
• Apply controlled automated actions only when expressly enabled and authorized by the user.

OAuth and account credentials

We use Google OAuth to request authorization. We do not ask users to provide their Google passwords. OAuth tokens are used only to provide authorized functionality and may be stored using access controls and security safeguards.

Ownership and billing

Users retain ownership and control of their Google accounts, Google Ads accounts, campaigns, advertising assets, billing profiles, and advertising budgets. Advertising charges are billed by Google through the user’s own billing arrangement. Smarter Growth OS does not become the owner of the user’s advertising account.

Revoking access

A user may disconnect Google Ads from Smarter Growth OS or revoke access through the user’s Google Account security settings. Revocation prevents future access but does not necessarily delete information previously stored. Users may request deletion as described below.

Prohibited uses

We do not sell Google user data, use it for unrelated surveillance, create unauthorized advertising profiles, or disclose it for unrelated advertising purposes.

Google Maps, Places and location information

Smarter Growth OS may use Google Maps Platform, Places API, geocoding services, or related Google services to find and display business listings, categories, websites, telephone numbers, ratings, reviews, addresses, geographic coordinates, and location-related information.

Google Maps or Places content may be displayed with required Google attribution. Users must not remove, conceal, or modify required attribution, notices, or links.

Location information may be used to:

• Identify businesses and service opportunities.
• Organize leads by location, category, and service area.
• Rank geographic markets and route clusters.
• Support campaign targeting and market analysis.
• Validate or geocode user-supplied addresses.

Google Maps and Places information remains subject to applicable Google Maps Platform terms, attribution rules, caching limitations, and usage restrictions.

USPS, address validation and direct-mail information

Smarter Growth OS may connect to authorized United States Postal Service APIs to support address validation, ZIP Code information, postal carrier routes, delivery statistics, residential and business delivery counts, Every Door Direct Mail planning, and related direct-mail workflows.

How USPS information may be used

• Validate or standardize addresses.
• Identify ZIP Codes and postal carrier routes.
• Estimate delivery counts and direct-mail coverage.
• Build user-selected mailing plans and route groups.
• Prepare mailing-related reports, exports, and campaign drafts.

USPS data is used only for authorized mailing, address, or postal functionality and remains subject to USPS API licenses, product restrictions, quotas, fees, and applicable postal requirements.

USPS is an independent government entity. Smarter Solutions LLC is not the United States Postal Service and does not guarantee postal delivery, route availability, delivery counts, postal pricing, mailing eligibility, or acceptance of a mailing.

Artificial intelligence and automated processing

Smarter Growth OS may use artificial intelligence and automated systems to analyze authorized business, campaign, lead, geographic, performance, and communication information.

AI features may:

• Generate campaign ideas, advertisements, emails, proposals, and recommendations.
• Summarize metrics and identify performance trends.
• Suggest budgets, keywords, negative keywords, targeting, and next actions.
• Score leads, opportunities, ZIP Codes, or campaign readiness.
• Detect unusual spending, performance changes, or incomplete setup.
• Assist with reports, forecasting, and marketing workflows.

AI-generated information may be inaccurate, incomplete, delayed, or unsuitable for a particular business. Users must independently review material recommendations before relying on them.

Material changes to campaigns require user approval unless the user has expressly enabled controlled automation. Even when automation is enabled, users remain responsible for their campaign settings, budgets, legal compliance, offers, claims, and business decisions.

Third-party service providers and integrations

We may use service providers to host, secure, analyze, communicate, process, or support the platform. Providers may include:

Each third-party service may operate under its own terms and privacy practices. The availability and functionality of integrations may change without notice.

How information may be shared

We may share information:

• With service providers acting on our behalf.
• At the direction or with the consent of the user.
• With an account owner, administrator, or authorized member of the same business account.
• To comply with law, legal process, court orders, or government requests.
• To investigate fraud, security incidents, misuse, or violations of this Agreement.
• In connection with a merger, acquisition, financing, sale, reorganization, or transfer of business assets.

We do not sell Google API user data. We do not disclose connected Google Ads data to unrelated third parties for their independent advertising or data-broker purposes.

Security

We use administrative, technical, and organizational measures intended to protect information from unauthorized access, alteration, disclosure, loss, or misuse.

These measures may include:

• Encrypted network transmission.
• Access controls and tenant separation.
• Secure credential storage.
• Role-based permissions.
• Audit logging and security monitoring.
• Backups and recovery procedures.
• Rate limiting and authentication controls.
• Vendor and infrastructure security reviews.

No system is completely secure. We cannot guarantee that information will never be accessed, disclosed, altered, or destroyed.

Users are responsible for maintaining the security of their accounts, using strong passwords, protecting devices, and promptly notifying us of suspected unauthorized access.

Data retention, disconnection and deletion

We retain information for as long as reasonably necessary to provide services, maintain account connections, complete transactions, generate reporting, preserve audit records, resolve disputes, enforce agreements, comply with law, and protect against fraud or security threats.

Retention periods may depend on the type of information, account status, contractual requirements, operational needs, and legal obligations.

Disconnecting integrations

Users may disconnect supported integrations through Smarter Growth OS or revoke authorization directly through the provider, including through Google Account security settings.

Deletion requests

Users may request deletion of eligible personal information, OAuth credentials, Google Ads data, USPS-related platform records, or Smarter Growth OS account data by contacting: [email protected] .

We may need to verify identity and account authority before processing a request. Eligible information will be deleted or anonymized within a reasonable period, except where retention is required for legal, tax, security, billing, fraud-prevention, dispute-resolution, backup, or audit purposes.

Privacy choices and rights

Depending on where a user resides, applicable law may provide rights to:

• Request access to personal information.
• Request correction of inaccurate information.
• Request deletion of eligible information.
• Request a portable copy of certain information.
• Withdraw consent where processing relies on consent.
• Object to or restrict certain processing.
• Opt out of promotional communications.
• Appeal a privacy-request decision where required by law.

Users may unsubscribe from promotional emails through the unsubscribe link included in an email. Administrative and transactional messages may still be sent when necessary to provide a service.

Children’s privacy

Our business and software services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that such information has been collected, we will take reasonable steps to delete it.

General Terms of Service

Users may use our website and services only for lawful purposes and in accordance with this Agreement.

Users may not:

• Access accounts or information without authorization.
• Misrepresent identity, authority, services, offers, or affiliation.
• Use the platform for fraud, spam, harassment, discrimination, or illegal activity.
• Upload malware or interfere with platform security or availability.
• Scrape, copy, reverse engineer, resell, or exploit the platform except as expressly permitted.
• Circumvent usage limits, API restrictions, security measures, or provider policies.
• Use third-party data in violation of applicable law or licensing terms.
• Create deceptive advertisements, prohibited content, or false claims.

Smarter Growth OS software terms

Smarter Growth OS provides tools for marketing intelligence, campaign preparation, account management, reporting, communication, lead organization, direct-mail planning, and AI-assisted recommendations.

Account authority

Users may connect or manage only accounts they own or are authorized to administer. Users are responsible for maintaining accurate account information and permissions.

Beta and developing features

Certain functions may be identified as beta, preview, testing, simulated, or under development. Such features may be incomplete, inaccurate, interrupted, or changed without notice.

No guaranteed results

We do not guarantee leads, customers, rankings, impressions, clicks, conversions, revenue, return on advertising spend, campaign approval, account approval, API approval, or any specific marketing result.

Customer responsibilities

Users remain responsible for reviewing and approving advertising content, claims, targeting, budgets, legal disclosures, privacy practices, intellectual-property rights, and compliance with platform policies and applicable law.

Google Ads and other advertising accounts

Each customer retains control of its advertising account, billing method, campaigns, budgets, and spending limits.

When a customer authorizes automation, the platform may perform approved actions within configured permissions and limits. Customers must monitor their accounts and promptly disable automation if they no longer want changes made.

Advertising platforms may reject, suspend, limit, or modify accounts or campaigns independently. Smarter Solutions LLC does not control third-party review decisions and cannot guarantee reinstatement, approval, placement, pricing, or delivery.

Cleaning-service terms

Quotes may be based on information, photographs, square footage, service selections, frequency, property condition, and other details supplied by the customer.

Prices may be adjusted when the actual property condition, scope, access requirements, safety conditions, or requested services differ materially from the information provided.

Access and preparation

Customers must provide safe and lawful access to the service location, identify hazards, secure pets, protect valuables, and disclose delicate, damaged, hazardous, or restricted areas.

Heavy or delicate items

We may decline to move heavy, delicate, connected, unsafe, or high-value items. Unless specifically agreed, customers should move such items before service.

Service concerns

Customers should report service concerns promptly and provide a reasonable opportunity for inspection or correction. Refunds, credits, or re-performance are not automatic and may depend on the circumstances and applicable written service agreement.

Subscriptions, billing and payments

Pricing, billing frequency, usage limits, included features, and cancellation terms may be shown at purchase, in an order form, proposal, subscription page, or separate agreement.

Users authorize applicable charges to the selected payment method. Recurring subscriptions may renew automatically until canceled in accordance with the applicable plan terms.

Taxes, advertising spend, postage, printing, third-party usage charges, API fees, and optional services may be billed separately unless expressly included.

Failure to pay may result in restricted access, suspension, late charges where permitted, collection activity, or termination.

Disclaimers

To the maximum extent permitted by law, the website, platform, integrations, recommendations, reports, generated content, and services are provided on an “as available” and “as is” basis.

We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted operation, non-infringement, and guaranteed results, except where a warranty cannot lawfully be excluded.

Data supplied by Google, USPS, customers, public sources, and other providers may be delayed, incomplete, unavailable, or inaccurate. Users should independently verify important information before acting.

Limitation of liability

To the maximum extent permitted by law, Smarter Solutions LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, customers, data, goodwill, business opportunities, or advertising performance.

Our aggregate liability arising from the software or related services will not exceed the amount paid by the user to Smarter Solutions LLC for the applicable service during the three months preceding the event giving rise to the claim, unless applicable law requires a different result.

These limitations do not apply where prohibited by law or to liabilities that cannot legally be limited.

Suspension and termination

We may suspend, restrict, or terminate access when reasonably necessary to address nonpayment, security risk, unlawful use, policy violations, provider requirements, fraud, abuse, or harm to users, third parties, or the platform.

Users may stop using the services and may cancel eligible subscriptions according to the applicable billing terms.

Provisions concerning ownership, payment obligations, disclaimers, liability, disputes, confidentiality, and data retention survive termination where appropriate.

Governing law and disputes

This Agreement is governed by the laws applicable to Smarter Solutions LLC’s principal place of business, without regard to conflict-of-law rules, except where consumer-protection law requires otherwise.

Before filing a formal claim, the parties agree to make a good-faith effort to resolve the dispute through written communication. Any required venue, arbitration provision, jury waiver, or state-specific notice contained in a separately signed agreement will control over this general section.

Changes to this Agreement

We may update this Agreement to reflect changes in our services, integrations, law, security practices, or business operations.

The updated version will be posted on this page with a revised “Last updated” date. When legally required, we will provide additional notice or obtain consent.
